  • Successfully defended operator of a "tube" website in Copyright and Trademark lawsuit, winning case on Summary Judgment (Hydentra HLP Int. Limited v. Luchian et al (S.D. Fla.)).

  • Successfully defended operators of two different user generated content websites in Copyright lawsuits by having the cases thrown out at the motion to dismiss stage for lack of personal jurisdiction (Hydentra HLP Int. Limited v. Maximum Apps Inc. et al (S.D. Fla.) and Hydentra HLP Int. Limited v. Sagan Limited et al (D. Ariz.)).

  • Successfully fought back attempted faulty service on foreign cyber-locker Oron, leading to dismissal of copyright infringement action (Flava Works, Inc. v. John Doe 1 to 26 et al (N.D. Ill.)).

  • Favorably settled copyright infringement lawsuit against client stock photo website for $2,000 (North Jersey Media Group Inc. v. DepositPhotos, Inc. (S.D.N.Y.)).

  • Represented cyber-locker defendant Hotfile in pre-trial motions and trial preparation in copyright infringement action brought by five major Hollywood movie studies (Disney Enterprises, Inc. et al v. Hotfile Corp. et al (S.D. Fla.)).

  • Defended cyber-locker Oron in copyright infringement action and briefed Ninth Circuit on interlocutory appeal regarding trial court’s finding of personal jurisdiction on Hong Kong based Oron and preliminary injunction freezing Oron’s assets (Datatech Enterprises, LLC v. FF Magnat Limited et al (9th Cir.) on appeal from (N.D. Cal.)).

Trademark and Domain Name Disputes:

  • Successfully recovered over 20 different infringing domain names from multiple registrants through the Uniform Domain Name Dispute Resolution Policy (UDRP) on behalf of an Alexa top 100 website (e.g. Hammy Media, Ltd. and xHamster IP Holdings Ltd. v. Konovalov (Nat. Arb. Forum)).

  • Defended tube site aggregator in trademark infringement action over an allegedly generic and descriptive trademark (Calista Enterprises Ltd. v. Tenza Trading Ltd. (D. Oregon)).

  • Successfully defended webmaster in Uniform Domain Name Dispute Resolution Policy (UDRP) proceeding on basis that client did not register domain name in bad faith given potentially generic nature of putative trademark (Tenza Trading Ltd. v. Domain Admin / WhoIs Privacy Corp. (Nat. Arb. Forum)).

  • Defeated trademark licensee in Uniform Domain Name Dispute Resolution Policy (UDRP) proceeding, stopping transfer of client's domain names, on basis that licensee did not have proper standing and that the underlying trademark was potentially invalid or abandoned (EvoPlay LLC v. Ziganshin (WIPO)).

  • Succeeded in obtaining transfer of ownership of two domains that infringed client’s trademark through Uniform Domain Name Dispute Resolution Policy (UDRP) proceeding (TM Web Properties, Ltd. v. Webzilla/Webzilla Ltd (Nat. Arb. Forum)).
